AGF can’t prosecute Ekiti murder cases – Commissioner

Ekiti State Attorney General and Commissioner for Justice, Mr. Owoseni Ajayi, on Monday, advised the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami, and the All Progressives Congress to stop chasing shadows

He was referring to speculations that Federal Government was considering reopening some murder cases committed during the first term of Governor Ayodele Fayose.

Ajayi said investigation into the cases had been concluded by the police in the state as well as the Force Headquarters in Abuja with those indicted charged to court.

He said a few of the suspects in the cases were discharged and acquitted. He added that some were on bail while others were facing prosecution.

Ajayi added that there was nothing left to investigate in the cases.

Ajayi also said that the allegation of certificate forgery against some members of the House of Assembly was a mere propaganda as no lawmaker had been indicted or invited for interrogation.

The Ekiti state AG said under the law of the country, the Department of State Services could only arrest, but lacked the power to investigate and prosecute suspects.

He added that the DSS could only turn such suspects to the police, the Economic and Financial Crimes Commission, as well as the Independent Corrupt Practices and other Related Offences Commission as the case might be.

He added that the Attorney General and Minister of Justice also lacked the power to prosecute.

He said, “Assuming without conceding that the House of Assembly members have cases to answer, such offences can only be prosecuted by the Ekiti State Attorney General and Commissioner for Justice at the State High Court and not the Federal High Court because they are not federal offences. From their story, it is clear that they only went on propaganda spree and daydreaming.”
